What is family law?

Family law is a broad area of law dealing primarily with issues that arise when spouses separate. The spouses may be married or common-law.

Family law typically involve such matters as: Parenting (custody and access) of children; Child support; Spousal or partner support; Division of property and debts;

Other issues that may arise are: Cohabitation pre-nuptial agreements; Adoption of children and adults; Guardianship of children; Applications for access to children by grandparents; Division of private pensions; Restraining orders in domestic situations; Orders for exclusive possession of a home or other property.

How can we help you?

There are various legal options available for spouses/partners who have separated or are about to separate. The appropriate options will depend on your specific circumstances and the parties involved.

Gather your financial information. This will speed up the process of resolving your matter. You will need this information whether your matter is resolved by agreement or through the Courts.

Should you decide to separate from your spouse/partner or if you have already separated, a family lawyer can help you fully understand your rights and obligations and plan and design your next steps for you.

If you are considering marriage or cohabitation, a family lawyer can provide you with advice regarding a prenuptial or cohabitation agreement.

Going through challenging times without adequate support will only increase your stress and anxiety. Your family lawyer can refer you to the services of other professionals such as parenting coordinators, counselors, tax experts and to community resources in the city.

Dispute Resolution:

While we always search for the best solution for you, mediation in Provincial Court is part of the regular process. Judicial Dispute Resolutions (JDR) meetings are conducted informally in a conference room setting. The process is confidential. All documents prepared for JDR and statements made by counsel, or by the parties, during JDR are confidential and without prejudice, and cannot be used for any purpose or in any proceeding other than JDR. Trials in Provincial Court are often part of the regular process.
A trial in the Court of Queen's Bench Court can be very costly. However, it is important to set trials for the right reasons and we are happy to discuss your options with you. If you are unable to come to an agreement about the division of your property a Court of Queen's Bench trial may be your only option.
